| President's Message Dear friends and fellow FESANS, Two men were riding a bicycle built for two when they came to a steep hill. It took a great deal of struggle for the men to complete what proved to be a very steep climb. When they got to the top, the guy in front said,"Man that was a hard climb!" | Proposed legislation for 2003 Florida Legislative Session Florida Senate - 2003 SB 678 By Senator Campbell 32-589-03 A bill to be entitled An act relating to trust funds; creating an electronics recycling account in the Solid Waste Management Trust Fund; providing a revenue source; providing for use of moneys in the account; providing for future review and termination or re-creation of the account; providing a contingent effective date. Be It Enacted by the Legislature of the State of Florida: Section 1. (1) The electronics recycling account is 13 created within the Solid Waste Management Trust Fund. Moneys from advance recycle fees paid under section 403.71853, Florida Statutes, shall be deposited into the account and shall be disbursed from the account according to that section for the purpose of making grants to counties for establishing programs for recycling or otherwise properly disposing of electronics products and components. (2) In accordance with Section 19(f)(2), Article III of the State Constitution, the electronics recycling account shall, unless terminated sooner, be terminated on July 1,2007. Before its scheduled termination, the account shall be reviewed as provided in section 215.3206(1) and (2), Florida Statutes 26 Section 2. This act shall take effect July 1, 2003, if SB ____ or similar legislation is adopted in the same legislative session or an extension thereof and becomes law. SENATE SUMMARY Creates an electronics recycling account in the Solid Waste Management Trust Fund to provide funding for grants to entities establishing comprehensive electronics recycling programs. Provides for future review and abolition or re-creation of the account. Florida Senate - 2003 SB 674 By Senator Campbell 32-330-03 A bill to be entitled An act relating to environmental control; creating s. 403.71853, F.S.; creating a program for the responsible disposal of certain electronic products and components; providing definitions; providing duties of the Departmentof Environmental Protection and other government entities and agencies and of marketers of such products and components; prohibiting certain methods of disposal of such products and components; providing for funding the program; providing for fees for sales of components and for a surcharge on waste disposal; providing penalties; creating a review council; providing for rules; providing an effective date. An incomplete summarization of the above bill is presented in this issue. (674) Florida Senate Bill 674 brief: Commences on Page 5 of this 13 page proposal. It is recommended that each reader review and understand the purpose and definitions as described on pages 1 through 4. PROHIBITION ON INCINERATION OR DISPOSAL OF ELECTRONIC PRODUCTS (a) Beginning January 1, 2004, for each county with a population of 100,000 or more, and beginning January 1, 2006, for each county with a population of fewer than 100,000, covered electronic products may not be disposed of in a lined or unlined landfill or incinerated in any municipal waste combustor or other incinerator. (b) This section is intended to create additional and cumulative limitations on the disposal of covered electronic products and may not be construed as authorizing the disposal of materials that are otherwise restricted by federal or state law, rule, regulation, or permit condition. (b) Advance recycling fees.-- 1. For the privilege of engaging in business, a fee for each television or computer monitor containing a cathode ray tube and for any other covered electronic product subsequently identified under subsection (5) sold at retail is imposed on any person engaging in the business of making retail sales of electronic products within this state. Beginning January 1, 2004, the fee shall be imposed at the rate of $10 for each product. The seller must provide notice to a purchaser that the advance recycling fee has been imposed on this product by identifying the fee on the cash receipt or by a display, sign, or notice in a prominent area of the store that the fee is being imposed. 2. The fee imposed by this section shall be remitted to the Department of Revenue monthly. The payment shall be accompanied by such form as the Department of Revenue prescribes. The proceeds of the electronic product advance recycling fee, less administrative costs, shall be transferred by the Department of Revenue into the Solid Waste Management Trust Fund and shall be accounted for separately in an electronics recycling account. The amount deducted for the costs of administration may not exceed 3 percent of the total revenues collected under this paragraph and shall be only those costs reasonably attributable to the fee. 3. In the last month of each fiscal year, the electronics recycling account shall be apportioned among all counties that have an electronics recycling program approved by the Department of Environmental Protection on the basis of population, and the Department of Revenue shall transfer such moneys to each eligible county. In order to be approved, a program must, at a minimum, provide an opportunity for recycling electronic products and provide public education about electronic-product-recycling services. (c) Solid waste disposal fee surcharge.--Each county shall impose a surcharge on its solid waste disposal fees to help fund its electronic product recycling program. Beginning January 1, 2004, the surcharge shall be imposed at the rate of $__ per ton of solid waste collected for disposal in a landfill or municipal waste combustor service as is currently reported annually to the Department of Environmental Protection. Such surcharge shall apply to Class I or Class II municipal solid waste whether or not it is disposed of in a facility within the county. Such surcharge shall be collected from the solid waste service ratepayers rather than at the solid waste disposal facility. Each county shall retain its surcharges in an account earmarked for and spent on its electronics recycling program. 4) MARKETER PRODUCT MANAGEMENT SYSTEM (a) Effective January 1, 2006, each marketer that sells and distributes covered electronic products in this state must: 1. Implement a product management system, other than a local government collection system, unless the local government agrees otherwise, through which covered electronic products may be returned to designated collection sites and submit a description of this system to the Department of Environmental Protection. The product management system may not impose any additional costs or fees on the final purchaser. The product management system must be accessible for consumers and for local governments that collect covered electronic products from household users. Marketers shall accept covered electronic products returned to them of the same general type, including differing brands, not to exceed the same annual rate as covered electronic products manufactured by them are sold in this state. Marketers shall provide for and have the sole responsibility for the recycling, reuse, or proper disposal of covered electronic products returned to them. 2. Clearly inform each purchaser of the system for return available to the purchaser for proper product collection, transportation, reuse, recycling, or disposal. A telephone number and electronic website address must be provided to each final purchaser of a covered electronic product so that the final purchaser can conveniently get information on returning the products for reuse, recycling, or proper disposal. The telephone number and electronic website address shall be affixed to either the exterior of the product or, for smaller products, its package and also provided in the instruction manual for the product in substantially the following form: "For information on how to recycle this product, call (telephone number) or visit (website address)." (b) Marketers may satisfy the requirements of this section individually or as part of a representative organization of marketers. Representative organizations of marketers shall supply to the department a list of those organization members for whom the association is satisfyiny the requirements of this subsection. (c) On January 1, 2007, and each January 1 thereafter, each marketer shall provide to the department an annual report on its product management system. The report shall include, at a minimum, an estimate of the number of covered electronic products that were sold in the state in the previous year; an estimate of the number and weight of covered electronic products collected in the state in the previous year; the capture rate for covered electronic products based on state sales; an estimate of the percentage by weight of collected materials that are reused and recycled from recovered covered electronic products; the end markets for major constituents of the recovered covered electronic products; and other information the department requires. (d) By January 1, 2005, each marketer shall submit to the department for its approval a plan describing how the marketer will satisfy the requirements of paragraphs (a) and (b). The department shall review submitted plans, request additional information as necessary, and approve or disapprove the plans within 6 months after submittal. (e) Marketers of covered electronic products who do not comply with the requirements of this subsection may not sell, distribute, or offer for sale in this state covered electronic products. (f) A marketer that violates any provision of this subsection is subject to a minimum fine of $100 per violation for each covered electronic product that is sold, distributed, or offered for sale in this state. COVERED ELECTRONIC PRODUCTS REVIEW COUNCIL There is created the Covered Electronic Products Review Council, to be administratively housed in the Department of Environmental Protection. The purpose of the council is to serve as the mechanism for coordination among the Legislature, state and local governments, and the private sector to coordinate policy and overall strategic planning for review of progress to date of the statewide program for the environmentally preferable management of covered electronic products and to make recommendations to the Governor and Legislature for changes to this program. The council may not duplicate or replace agency programs but may enhance, coordinate, and recommend priorities for those programs as it makes recommendations to the Governor and Legislature. (b) The council shall consist of 12 members, four each to be appointed by the Governor, the President of the Senate, and the Speaker of the House of Representatives, each of whom is or has been actively engaged in the recycling industry, manufacturing electronic products, economic development, solid waste management, or a related business, trade association, or governmental area. review the entire bill then contact your Rep. |

| Busted In Las Vegas The title of this article may have many applications to some; however, never having wagered a cent in a Las Vegas slot machine or playing their games of chance eliminates those options for me, leaving only one conclusion. My most unforgettable encounter was with the authorities at their request. At the conclusion of the recent NESDA winter meetings our trip to return home was scheduled to depart from McCarran International Airport in Las Vegas at 3:20 PM PST on January 15, 2003. Since the hotel check out time was 12:00 noon we checked out and took a Taxi straight to the airport to await our departure. The line at the airline baggage check-in was small and I passed through it rather quickly. With ticket in hand and wheeling my computer in a carry on case behind me we headed for the departure concourse. Doug and I joked about which one of us would be pulled aside because we were both carrying our computers having previously noticed people taking these as carry on luggage consistently draw extra attention from the screeners at the boarding areas. Approaching the concourse entry everything seemed normal as we removed our computers from their case when instructed, placing each in separate baskets to be X-Rayed. I was able to pass through the first stage metal detectors without a hitch waiting to gather all my possessions from the X-Ray belt. After carefully re-packing all my belongings I was approached by a TSA agent who informed me he wanted to go through my carry-on belongings in more detail. No problem...go for it. I looked up and grinned at Doug, who had already cleared this check and was patiently waiting for me on the "cleared" side with a smile. The agent removed my computer, took a round patch he moistening from a partially filled spray bottle, and then proceeded to wipe my computer with it. Next he inserted this patch between two vertical posts that looked similar to a paper holder seen on any desk. I guess I hit the jackpot. He told me that he got a "hit" and printed out a graph that looked like three Rhino horns rotated 90 degrees on a base line. He then began waving his arms while asking for assistance from agents across the room. Upon arrival they immediately informed me that I tested positive for having explosives. Then I was informed that I would have to remove my shoes and anything else they may deem necessary. I told this gentleman should he find anything explosive, please show it to me because I didn't want to be near it either. He laughed as he began filling out a very lengthy form on his clipboard. He wanted my picture ID...no problem since I had already shown it several times. However he didn't want my U.S. Navy ID card. I couldn't understand why this wasn't acceptable since I had used this government ID in lieu of a passport. When I ask why, he said it didn't have an address on it insisting upon seeing my state drivers license instead. After looking that over he ask me if the address listed on my drivers license was a good address. To which, I responded, "It was when I left" while removing my shoes. They used a separate patch and swabbed down each shoe, one at a time, placing each patch in the same detector three times. When no further indications were obtained I was then told to put my shoes back on. The gentleman filling out this form while using my driver's license asks me if I regularly took any medications. I told him that I did and of course he had to know what they were. I can't even pronounce most of them to say nothing of properly spelling any. I began trying to name each of them, as I was able to recall. After all that is the story of how I started this trip. I was getting all my medications together at home, placing them all into one container so that I could carry them on with me. I have never chanced them being lost in my checked baggage because of all the detail it would require to have them replaced. I went through each bottle carefully measuring every day's dosage then placing each into a single container to place in my medication bag. I didn't put them in the bag at the time because it becomes much more difficult to place the insulin with an ice pack in the same container. I managed to overlook this until arriving in Dallas to connect with my Las Vegas flight. I called home and ask my wife to overnight the medications that I had hastily managed to forget. It took $41.00 and until Monday at 10:30 AM PST to get my medication that I had walked out and left Friday evening. Now this gentleman needs me to name each of those medications. As I went through my litany of heart medications this gentleman ask me if by chance I ever took nitroglycerine? I told him that I did and reached into my pocket to produce the small vial that I had. Everything then changed as the gentleman said, "I've found it. He's on Nitroglycerine." This is the reason the machine had indicated I was carrying explosives. They gave me back all my equipment and helped me pack them in my case. When you think about what just occurred it is rather impressive. I hadn't taken my high blood pressure medications because I had forgotten to pack them, but I had taken nitroglycerine several times to relieve my chest discomfort when walking that long distance between our hotel and the meeting rooms. After receiving my medications I had taken no nitroglycerine since Monday evening. Wednesday afternoon nitroglycerine was detected on my computer because I had used this computer after taking the nitro. It is hard to believe this detection was made from deposits of body oil from my fingers touching the keys over 48 hours prior. It should make you feel a little bit safer knowing these machines can detect such small amounts of explosive residue. We may all be safer because of it. |

| Industry Updates Circuit City Service ..Circuit City began closing 10 of their existing 17 National Service Centers . This could negatively impact approximately 1000 present employees. Small products will then be shipped to the 7 remaining Service Centers as service is required. In areas where these service centers are closed, field service technicians will work out of the nearest Retail store. They are planning to expand their road service network in this manner. CPSC, Zenith Announce Recall to Repair Large-Screen, Analog Projection Televisions WASHINGTON, D.C. - In cooperation with the U.S. Consumer Product Safety Commission (CPSC), Zenith Electronics Corp., of Lincolnshire, Ill., is voluntarily recalling to repair about 80,000 large-screen, analog projection televisions manufactured between 1995 and 1998. This recall is an expansion of a 1998 recall program involving 111,000 projection television sets. A tear in a gasket can cause coolant fluid to leak from the picture tube assembly. This can cause smoking, charring, and electrical arcing inside of the television, posing a fire hazard to consumers. Since 1998, Zenith has received 45 reports of incidents involving coolant leakage, causing smoking or charring with the televisions, including four cases where minor property damage occurred outside of the unit. No injuries have been reported. The projection televisions recalled in this expansion and the earlier program have 46-60 inch screens and were manufactured from April 1995 through July 1997, and August 1998 through November 1998. The date of manufacture can be found on the white label on the back of the set. These televisions were manufactured in Mexico. Projection televisions manufactured after 1998 are not included in this recall. Major appliance and department stores nationwide sold these televisions from about April 1995 through April 1999 for between $1,200 and $2,800. Consumers who have one of these televisions should pick up the phone immediately and contact Zenith at (800) 777-5195 anytime to arrange for a free inspection and repair. Consumers also can visit the company's dedicated website at http://www.projorecall.com. In cooperation with CPSC, Zenith conducted a recall beginning in 1998, in which they notified owners of the television sets covered by the program, which resulted in 61,000 units being repaired. This notice is intended for consumers who did not participate in the first program or have one of the 80,000 televisions being added to the 1998 program. |

| Member Updates Annie L. Tracy wife of Harold S. Tracy passed away on Saturday January 25, 2003 at Memorial Medical Center. She was 70 and a member of the Englewood Christian Church of Jacksonville, Florida. Survivors include her husband of 50 years Harold S. Tracy, a son Davis and daughter Anna Lee Sessions, a sister Audrey Williams and five grandchildren. Graveside services were held at 11:00 AM on Wednesday, January 29th, 2003 with Rev. Ken Gemeinhart officiating. In lieu of flowers the family requests all contributions made to the Englewood Christian Church Missions Program. All FESAns mourn this loss of "Tracys" beloved wife and extend our deepest sympathies to him with all his family. Just "Tracy" was the name he was so fondly known by over so many years as he became an integral part of our servicing family employed at "Mitchell Electronics" for many decades. May the Lord provide them with continuing comfort and peace in this devastating loss for all of us. Jo Ann and Ken Cission Celebrate Golden Wedding Anniversary on February 14th, 2003. On Friday, February 14th, 50 years of marriage was achieved for this all FESA family. The event was celebrated with family and many friends at the Arlington Women's Club in Jacksonville, Florida. In attendance was their entire family, many of whom traveled from South Carolina just for this special event. They enjoyed the evening complete with special live music by "The Silver Haired Trio plus Susan" who traveled all the way from Brunswick, Georgia to provide the proper music and atmosphere for this event. The Cissons renewed their wedding vows with everyone present. It was a great event and an achievement that few marriages survive to endure. Miss Jo was dressed in a Golden suit that matched her hair while Ken took advantage of his dancing shoes he chose to wear for this occasion. Everyone enjoyed a splendid evening including a meal of ham or roast with all the trimmings, dessert, all kinds of beverage, plenty of good music and dancing topped off with a whole lot of outstanding fellowship. I think it safe to say everyone enjoyed themselves and wish Ken and Jo fifty more years together. Mr. Earl Redman is presently recuperating at the Good Samaritan Hospital, on 5601 Loch Raven Blvd. in Baltimore, MD 21239. He suffered complications after undergoing outpatient nasal surgery leading to a stroke that temporarily left him without speech, however his speech has returned. His spirit is high and he told me, "He intends to be dancing at the upcoming Mid Atlantic Conference in Delaware." He is presently undergoing speech and physical therapy at this facility. I believe that he will meet his goal. He will be missed at NASC this year. Please take the time to drop him a note of encouragement at the above address then join with me to include him in our prayers until we see him dancing once again. |

We also used this meeting as an opportunity to request his assistance in reducing the required time of 6 months prescribed by this statute. As we previously reported in a prior issue, we requested that the required holding time be reduced to a maximum of 90 days that conforms with many other areas in the country. It is to our advantage to seek this change because it provides servicers the means to recoup their investment in repaired abandoned customer products without any additional costs beyond those of sending certified mail. Without this statute it is much more costly requiring advertised notification and unreasonable time constraints that would almost always render cost recovery for a servicer non existent considering the low existing product price structure. Senator Wise is responsible for introducing our legislation previously reducing the 1 year time required in 1996 at our request, when serving in the Florida House of Representatives. | Panasonic CT-32G4A Our ability to select a defective replacement part never seems to end. The above model came in with the complaint "it wont turn on." After troubleshooting and verifying the complaint it was noted that the relay clicked when the unit was turned on but nothing else followed. The Regulator IC (Q801/STR58041) was suspected to be defective and another one sought. The first one our technician found was a new one in a "SK" bag. How lucky can you be? When it was installed he noticed those pre-shaped legs were just the opposite of that required. This is the second real tip off that clues one to identify counterfeit parts. The first one could be when it comes in an "SK" part bag. Good chance it may be a bogus part sold for an exact replacement and most probably worthless as any replacement. When I think of their ads my anger rises recalling that "Trust Me" theme. This is an on going industry-wide problem that truly must be corrected. When a real replacement part was located and installed we found a few other defective components that needed to be replaced also. The horizontal output transistor (Q551/2SD2539) was shorted and replaced along with a couple of diodes in the regulator circuit D824 that we replaced with a NTE558 and an avalanche diode (D825) hung off the regulator as protection. This is a special diode hung across the 130V source and ground to zener at some selected voltage above the normal 130V provided by a properly operating regulator circuit. This diode D825 had R2KL on the body of the diode and we had to order a replacement P/N TVSSR2KL1. Upon receipt of the above diode and after installation service was finally successfully completed and this unit was once again operating as it was designed. .Editor Watts Current |
